Selling Your San Antonio Home: FSBO vs. Hiring a Listing Agent (2026)
By Chris Dudley, San Antonio REALTOR® and founder of Legacy Realty Group, brokered by Real Broker, LLC (TREC #731381). Updated October 2026.
Selling "for sale by owner" (FSBO) is legal in Texas, and some sellers do it well, especially when they already have a buyer, like a relative or neighbor. This guide lays out what you take on when you sell yourself, what a listing agent does, and how to decide.
How common is FSBO?
Not very. In the National Association of REALTORS® 2025 Profile of Home Buyers and Sellers (sales from July 2024 to June 2025), only 5% of sales were FSBO, a record low. The typical FSBO home sold for $360,000, compared with $425,000 for agent-assisted homes. That gap partly reflects different kinds of homes, so it is not proof that an agent adds a fixed amount. About 30% of FSBO sellers sold to someone they already knew. (Source summary)
What you handle yourself as a FSBO seller in Texas
- Pricing. Without MLS comparable sales, many owners price from online estimates. Overpricing usually means more days on the market and price cuts later.
- Disclosures. Sellers of a previously occupied single-family home must give the buyer the Seller's Disclosure Notice required by Section 5.008 of the Texas Property Code. TREC publishes the current form (TREC 55-1, effective May 28, 2026). (TREC)
- The contract. Most Texas resale homes sell on the TREC One to Four Family Residential Contract, with deadlines for the option period, earnest money, financing and the title commitment. Missing a deadline can cost you the deal or your leverage.
- Marketing and showings. Photos, listing sites, yard signs, scheduling showings, and screening for buyers who are actually pre-approved.
- Negotiation. Offers, counteroffers, and the repair requests that come after the buyer's inspection.
- Buyer-agent pay. Most buyers have an agent. Under the NAR settlement practice changes that took effect August 17, 2024, offers of buyer-agent compensation are no longer posted on the MLS and buyers sign written agreements with their agents. A FSBO seller should decide up front whether to offer anything toward the buyer's agent, because buyers will ask. (NAR)
- Closing. In Texas the title company handles the closing, but you still coordinate the survey, HOA resale certificate (if any), payoff and repairs.
What a San Antonio listing agent does
- Builds a comparative market analysis from SABOR MLS data, so the price is set by recent sales in your neighborhood.
- Puts the home on the MLS, which feeds Zillow, Realtor.com, Homes.com and other sites, and markets it to buyers and their agents.
- Screens buyers, runs showings, and negotiates price, repairs and terms.
- Manages the TREC contract deadlines with the title company through closing.
When FSBO can make sense
- You already have a buyer (family, a tenant, a neighbor).
- The home is in a high-demand area and in move-in condition.
- You have time for showings and are comfortable negotiating with a buyer's agent.
Even then, many sellers pay a real estate attorney to review the contract.
Questions to ask before you decide
- What did homes like mine sell for in the last 90 days, and how long did they take?
- Will I offer anything toward a buyer's agent?
- Who will handle the option period and repair negotiation?
- What is my plan if the home doesn't sell in 30 days?
Frequently asked questions
Can I sell my house without a realtor in Texas?
Yes. Texas does not require a real estate agent to sell your own home. You still must give the buyer the Seller's Disclosure Notice for a previously occupied single-family home, and most sales close through a title company.
How many sellers go FSBO?
About 5% of U.S. home sales were FSBO in NAR's 2025 Profile of Home Buyers and Sellers, a record low.
Do I have to pay the buyer's agent if I sell FSBO?
No law requires it. Buyer-agent pay is negotiable and is set out in the buyer's written agreement with their agent. Many buyers will ask the seller to cover some or all of it as part of their offer.
What does a listing agent cost in San Antonio?
Commissions are not set by law and are negotiable. Ask any agent you interview what is included and get it in writing in the listing agreement.
Can an agent help if I already have a buyer?
Yes. Some sellers hire an agent only to handle pricing, the TREC contract and closing. Ask about it when you call.
